Mater Rixarum?

English summary: Church-state agreements with the traditionally dominant Christian churches are an old and oft-studied instrument for the coordination of their respective laws and interests, but were also always an object of conflict: Concordatum- mater rixarum. Julia Lutz-Bachmann carries out a constitutional study of the development of church-state agreements towards an equitable constitutional law of religious agreements, especially in the second half of the twentieth century. Building on historically derived information and an illumination of fundamental constitutional problems on this area of law, the author analyses the content and constitutional implications of agreements of states with Jewish and Muslim communities. The results of this study show that the religious agreement remains a mater rixarum or mother of disputes, but it also is successful within the terms of a religiously pluralistic territory and contains through the creation of justice in individual cases, multiple chances to establish balance and the creation of peace in friendship-promoting neutral state. Julia Lutz-Bachmann widmet sich der verfassungsrechtlichen Untersuchung der Fortentwicklung des Staatskirchenvertragsrechts hin zu einem paritatischen Religionsverfassungsvertragsrecht insbesondere in der zweiten Halfte des 20. Jahrhunderts. Aufbauend auf einer historischen Herleitung und einer Beleuchtung der grundsatzlichen verfassungsrechtlichen Probleme dieses Rechtsgebiets analysiert sie Inhalte und verfassungsrechtliche Implikationen von Vertragen des Staates mit judischen und muslimischen Gemeinschaften. Im Ergebnis zeigt sich, dass der religionsverfassungsrechtliche Vertrag zwar " mater rixarum " bleibt, er sich aber auch unter den Bedingungen einer pluralen religiosen Landschaft neu bewahrt und durch die Herstellung von Einzelfallgerechtigkeit vielfaltige Chancen zu Ausgleich und Befriedung im freundlich-fordernden neutralen Staat birgt.
